Underinsured Motorist Claim

HELP! You have been severely injured in an accident and need immediate surgery and medical care. You were knocked unconscious and when you wake up you really do not know what is going on, your first thought is “how am I going to afford this expensive surgery”? The next day, you find out the other driver has car insurance, BUT you know the coverage they have is not sufficient to cover your surgery costs. What do you do? Do you pay out of pocket? Great news, there is protection in these type of scenarios and it called Underinsured Motorist.

What is underinsured motorist coverage?

Underinsured motorist coverage is designed to cover you and the people in your car for medical bills, lost wages and pain and suffering if you are in an accident caused by someone who did not have enough insurance coverage to cover all of your medical bills. For example, if a driver with the minimum Texas liability insurance coverage cannot fully pay for your injuries they cause you, underinsured insurance coverage will step in and help out with your medical bills. I know what you are thinking, is it worth it, money wise, for this extra protection? Quick answer, absolutely. Underinsured motorist coverage can help you when the at-fault driver does not have enough insurance coverage to cover all damages and expenses, and can save you from paying out-of-pocket expenses and medical bills for an accident that was not your fault.

What is the difference between uninsured and underinsured insurance coverage?

Uninsured insurance coverage protects you if you were in an accident with an at-fault driver who does not carry liability insurance. Underinsured insurance coverage comes in when you are in an accident with an at-fault driver who liability limits are too low to cover all medical expenses to injured people involved in the accident. The at-fault driver will typically pay for all damages up to their insurance policy limits, if this is not enough for all damages, then your underinsured coverage may cover the excess amount of damages.
